1. Eligibility: The Gaylord Palms Hidden Holiday Gnome Hunt is open to all guests and visitors to Gaylord Palms Resort, age 18 years and older, during the promotion period. Employees, officers and representatives of Gaylord Entertainment Company (sponsor), and the respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employees are not eligible. Subject to all federal, state and local laws and regulations. Odds of winning depend on the number of eligible entries received.
2. Sponsor: Gaylord Palms Hotel & Convention Center, 6000 W Osceola Parkway, Kissimmee, FL 34746.
3. Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor and judges, which are final and binding in all matters related to the Sweepstakes.
4. Timing: The Sweepstakes begins at 12:01 p.m. Eastern Time ("ET") November 13, 2009 and ends at midnight ET, January 3, 2010 (the "Promotion Period").
5. How to Enter: To enter, qualified participants must complete the online entry form located at www.gaylordpalms.com/gnomehunt. Online forms must be completed, including contact information of the participant and the location of any ten (10) gnomes to be found at select locations on the property of Gaylord Palms Resort. Limit: one (1) entry per person. Any duplicate entries will be destroyed.
6. Drawing: The Sweepstakes Drawing will be conducted in accordance with these Official Rules on or about January 10, 2010. The random drawing will be conducted from among all eligible entries received in accordance with these Official Rules. Entrant selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winner need not be present to win. One potential winner will be selected from all eligible entries, and will be contacted by a representative of Gaylord Palms Resort & Convention Center by both telephone and email. If a potential winner cannot be contacted, prize is returned as undeliverable, or fails to sign and return the affidavit of eligibility and liability/publicity release, potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor will award their prize to an alternate winner. Only three (3) alternate winners will be selected after which the prize will remain unawarded.
7. Prize: ONE (1) GRAND PRIZE: The Gaylord Palms VIP Experience for two (2) will be awarded to one (1) winner selected at random from eligible entries. Prize includes a two (2) night stay at Gaylord Palms Resort in Kissimmee, FL, in a Presidential Suite; dinner for two (2) at Old Hickory Steakhouse; two (2) 50-minute spa treatments at Relāche Spa at Gaylord Palms Resort; self-parking and daily resort fee. Travel dates are subject to availability, some restrictions may apply. Prize must be redeemed by December 25, 2010. Prize package does not include transportation or incidental expenses. All prizes claimed will be awarded. Prize cannot be transferred, substituted or redeemed for cash, or used in conjunction with any other program, offer, discount or competition. All prizes claimed will be awarded.
8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
9. General Conditions: Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Release: By entering this Sweepstakes, entrant agrees to release and hold harmless, Gaylord Palms Resort & Convention Center, Gaylord Entertainment Company, each of their related companies, affiliates, parents, and each of their respective officers, directors, employees, shareholders, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize.
11. Limitations of Liability: The Released Parties are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes.
12. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Court in the State of Florida; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
